Article 1 – Definitions
In these terms and conditions, the following definitions apply:
Withdrawal period: the period within which the consumer may exercise their right of withdrawal from the contract;
Consumer: a natural person who does not act in the exercise of a profession or commercial activity and concludes a distance contract with a professional;
Day: calendar day;
Ongoing transaction: a distance contract relating to a series of products and/or services, where the obligation to deliver and/or collect is spread over time;
Durable medium: any means enabling the consumer or professional to store information addressed to them personally, in a way that allows future consultation and reproduction without alteration;
Right of withdrawal: the consumer's right to withdraw from a distance contract during the withdrawal period;
Professional: a natural or legal person who offers products and/or services to consumers at a distance;
Distance contract: a contract concluded within the framework of a system of distance selling organised by the professional, where, up until the conclusion of the contract, one or more distance communication techniques are used exclusively;
Distance communication technique: a means that can be used to conclude a contract without the consumer and professional being physically present in the same location at the same time;
General Terms and Conditions: these General Terms and Conditions of the professional.

Article 3 – Scope
These general terms and conditions apply to every offer made by the professional and to every distance contract and order concluded between the professional and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract that the general terms and conditions are available for inspection at the professional's premises and that they will be sent to the consumer free of charge as soon as possible upon request.
If the distance contract is concluded electronically, and by way of derogation from the preceding paragraph, the text of these general terms and conditions may be made available to the consumer electronically before the conclusion of the distance contract, in such a way that the consumer can easily store it on a durable medium. If this is not reasonably possible, it will be indicated before the conclusion of the distance contract where the general terms and conditions can be consulted electronically and that they will be sent to the consumer electronically or otherwise free of charge upon request.
In cases where, in addition to these general terms and conditions, specific conditions relating to products or services also apply, paragraphs two and three apply accordingly, and in the event of a conflict between the general terms and conditions, the consumer may always invoke the provision most favourable to them.
If one or more provisions of these general terms and conditions are at any time wholly or partially null and void or become so, the contract and the remaining conditions remain valid, and the provision in question will immediately be replaced by mutual agreement with a provision that approximates as closely as possible the intention of the original.
Situations not regulated by these general terms and conditions must be assessed in accordance with the "spirit" of these general terms and conditions.
Any ambiguities regarding the interpretation or content of one or more provisions of these conditions must be interpreted in accordance with the "spirit" of these general terms and conditions.
Article 4 – Offer
If an offer has a limited period of validity or is subject to conditions, this will be clearly stated in the offer.
The offer is non-binding. The professional has the right to modify and adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered. The description is sufficiently detailed to enable the consumer to properly evaluate the offer. If the professional uses photographs, they must be a faithful representation of the products and/or services offered. Obvious errors or omissions in the offer are not binding on the professional.
All photographs, specifications and data contained in the offer are for informational purposes only and cannot serve as the basis for a claim for compensation or termination of the contract.
Product photographs are a faithful representation of the products offered. The professional cannot guarantee that the colours displayed correspond exactly to the actual colours of the products.
Every offer contains information such that the consumer has complete clarity regarding the rights and obligations associated with accepting the offer.
Article 5 – Contract
The contract is concluded from the moment the consumer accepts the offer and fulfils the specified conditions.
If the consumer has accepted the offer electronically, the professional will immediately confirm receipt of that acceptance electronically. Until confirmed by the professional, the consumer may cancel the contract.
If the contract is concluded electronically, the professional will take appropriate technical and organisational measures to secure the electronic transmission of data and ensure a safe internet environment.
The professional may make enquiries regarding the consumer's creditworthiness. If the professional has justified reasons not to conclude the contract, they have the right to refuse the order, stating the reason.
The professional will provide the consumer with the following information in writing: the professional's registered address, the conditions of withdrawal, warranty information, the details referred to in Article 4, and the requirements regarding termination of the contract.
Each contract is concluded subject to the suspensive condition of sufficient availability of the products.
Article 6 – Right of Withdrawal
When purchasing products, the consumer has the option to withdraw from the contract without giving any reason within a period of 14 days. The withdrawal period begins on the day following receipt of the product.
During the withdrawal period, the consumer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to assess whether they wish to keep it. If the consumer exercises their right of withdrawal, they will return the product with all accessories provided and, where possible, in its original condition and packaging.
If the consumer wishes to exercise their right of withdrawal, they are required to notify the professional within 14 days of receiving the product, in writing or by email. The customer must then return the product within 14 days to the original address.
If, upon expiry of the deadlines mentioned above, the customer has neither notified their intention to exercise the right of withdrawal nor returned the product, the purchase is final.
Article 7 – Costs in Case of Withdrawal
If the consumer exercises their right of withdrawal, the consumer bears the cost of returning the products.
If the consumer has made a payment, the professional will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided the product or complete proof of dispatch has been received.
Article 8 – Exclusion of the Right of Withdrawal
The professional may exclude the consumer's right of withdrawal for certain products, provided that this exclusion is clearly stated in the offer.
Article 9 – Pricing
During the period of validity stated in the offer, prices will not be increased, except for changes resulting from adjustments to applicable taxes or duties.
Price increases within 3 months of concluding the contract are only permitted if they result from statutory provisions. Price increases after 3 months are only permitted if the professional has reserved this right and the consumer has the right to terminate the contract.
The place of delivery is located within the United States. Applicable state sales tax may be applied at checkout depending on the delivery address.
All prices are subject to typographical errors. The professional is not obliged to deliver at the incorrect price.
Article 10 – Conformity and Warranty
The professional guarantees that the products comply with the requirements of the contract and applicable laws.
The professional exclusively sells carafes as a product. The carafes are delivered without contents. Any liquid visible in photographs is for illustrative purposes only.
Defects must be reported within 14 days of delivery. Returns must be made in the original packaging and in as-new condition.
The warranty period corresponds to the manufacturer's warranty period. The warranty does not apply if the consumer has repaired or modified the products themselves.
Article 11 – Delivery and Fulfilment
The company will fulfil orders without delay, but no later than within 30 days, unless the consumer has agreed to a longer timeframe. If delivery is delayed, the consumer will be notified no later than within 30 days.
The consumer has the right to cancel the contract free of charge and the right to any applicable compensation in the event of non-delivery.
The risk of damage rests with the professional until the moment of delivery to the consumer.
Article 12 – Ongoing Transactions
The consumer may at any time terminate a contract concluded for an indefinite period, with a notice period not exceeding one month. A fixed-term contract may be terminated at the end of the agreed period.
Article 13 – Payment
Amounts due must be paid within 7 working days. The consumer is obliged to notify the professional of any inaccuracies in the payment details provided.
Article 14 – Complaints Procedure
Complaints must be submitted to the professional within 7 days and will be examined within 14 days of receipt. If found to be justified, the professional will replace or repair the products free of charge.
Article 15 – Disputes
These general terms and conditions and all contracts concluded between the professional and the consumer are governed exclusively by the laws of the United States of America. Any disputes arising from or related to these terms and conditions shall be subject to the jurisdiction of the competent courts of the United States.
Delivery Time and Shipping
Below you will find the average delivery time for all our orders:
After placing an order, we require 1 to 3 working days to process it. On weekdays, this typically takes 1 day, but if an order is placed on Friday evening or over the weekend, this period may be slightly extended. Once the order has been processed, it is dispatched and delivery takes an average of 6 to 12 working days.
